We believe women deserve garments that are just as comfortable as they are effective — without ever sacrificing style. Our goal is to embolden women of all shapes and sizes through high-quality clothing and shapewear that can be worn with pride. At Honeylove, we take your privacy seriously. This Privacy Notice (“Notice”) informs you how we handle privacy matters and collect, use and disclose your Personal Information (as defined below).

Scope

This Notice applies when you use or access the website www.honeylove.com, and its subdomains or portals (the “Site”), or otherwise provide Personal Information or interact with us online, on the phone, or in-person. For the purpose of this Privacy Notice, "Personal Information" means any information relating to an identified or identifiable individual that is protected by applicable privacy laws. We refer to all of the above as “Services.” By using the Services, you also agree to our Terms of Service

Where applicable, we indicate whether and why you must provide us with your Personal Information, as well as the consequences of failing to do so. If you do not provide Personal Information when requested, you may not be able to benefit from our Services if that Personal Information is needed to provide you with the Services or if we are legally required to collect it.

What Information We Collect

This section describes what information we collect from you through the Services. We may receive information (including Personal Information) in the following ways:

Information That You Provide to Us

As you interact with our Services, we collect Personal Information as follows:

  • Account registration. Includes contact and account information such as your first and last name, email address, home or business address, shipping address, telephone numbers, mobile numbers, and passwords;
  • Financial information. Includes credit card or debit card number, bank account information and your payment, service, and purchase history, which is collected by our third-party payment processor on our behalf;
  • Body measurements. Includes height, weight, waist size, hip size, cup size, and others;
  • Social media information. Includes social media handles, content, and other data disclosed to us through third-party features that you use on our Services (such as tools, payment services, widgets and plug-ins offered by social media services like Facebook, Instagram, Twitter, Pinterest and YouTube) or posted on social media pages (such as our social media page or other pages accessible to us); and/or
  • Other information. Includes information that you include via the chat function on the Site or provide during a customer service call, or any other information that could reasonably be used to identify you personally or identify your household or device (note that if you engage in an online or phone customer service chat or interaction with us, we will record and store those conversations for our training and quality assurance purposes)

We may also obtain Personal Information from you where you expressly provide us with the information. Examples of sources from which we collect information include letters, e-mails or other communications from you, web forms or inputs/uploads into our Site, and documents you have provided to us.

Information That Is Automatically Collected

Like many businesses, we and/or our service providers may automatically collect and/or store certain information when you visit or interact with the Services (“Usage Information”). This Usage Information may be stored and/or accessed from your personal computer, laptop, tablet, mobile phone or other device (a “Device”) whenever you visit or interact with our Services. Usage Information may include:

  • Your IP address and unique device identifiers;
  • Your Device functionality (including browser, browser language, settings and behavior, operating system, hardware, mobile network information);
  • Referring and exit web pages and URLs;
  • The areas within the Site that you visit and your activities there, including remembering you and your preferences;
  • Your general Device location or other location information, including the zip code, state, or country from which you accessed the Services;
  • Certain other Device data, including the time of day you visit our Site or other information used to provide analytics or other usage information; and
  • Information about your engagement with our emails.

For location information, some of our Services may include features based on users’ more precise GPS locations, in accordance with user consent and device settings, and may report on users’ current locations (“Location-Based Services”). To the extent you use any Location-Based Services, we may collect and store information about your location at the time you use those Location-Based Services (in addition to some automatically collected geolocation data). This information can come from a variety of sources depending on the device you use to access the Services; for example, a mobile phone may report its GPS location at the time Location-Based Services are used. 

If you no longer wish for us or our service providers to collect and use location information, you may disable the location features on your device. Consult your device manufacturer settings for instructions. Please note that if you disable such features, your ability to access certain features, Services, content, promotions, or products may be limited or disabled.

Information Collected from Third Parties

The Site may include functionality that allows certain kinds of interactions between the Site and your account on a third-party website or application. The use of this functionality may involve the third-party site providing information to us. For example, we might obtain information about the traffic and usage of Honeylove from third parties. We might also provide links to facilitate sending a communication from the Site, or we may use third parties to facilitate emails or postings to social media (like a “Share” or “Forward” button). These third parties also use cookies and other tracking technologies to capture information about your interactions with Honeylove. 

We may also receive information about you from other sources, such as business partners, marketers, researchers, analysts, social network services, and other parties (such as other users that ship items to you or purchase a gift card for you) to help us supplement our records.

In addition, Honeylove works with survey-takers to gather information about your experience with us after you have made a purchase. 
Honeylove does not have control over the information that is collected, used, and disclosed by these third parties. We encourage you to review the privacy statements of these third parties to understand their privacy practices.

De-Identified Data

We may de-identify information we collect so the information cannot reasonably identify you or your device, or we may collect information that is already in de-identified form. Our use and disclosure of de-identified information is not subject to any restrictions under this Privacy Notice, and we may use and disclose it to others for any purpose, without limitation.

How We Use Your Information

We process your Personal Information for the following purposes: 

  • To respond to requests for information about Honeylove and our Services;
  • To provide products and Services to you;
  • To help you register for an account with Honeylove;
  • To verify your identity and to detect and prevent fraud;
  • To provide you with marketing communications about Honeylove or third-party products and services we think would interest you;
  • To provide you with targeted online advertisements;
  • To participate in our referral program;
  • To provide you with transactional/relationship updates and other information about Honeylove and our Services;
  • To administer and allow you to participate in Honeylove sweepstakes, promotions, contests or surveys (note that, when participating in surveys, any information you provide in the comments field will be disclosed to us, so please do not include any sensitive personal information or other information you do not wish to disclose);
  • To improve the effectiveness of our Services;
  • To protect the security and integrity of our Services;
  • To comply with the law and protect the safety, rights, property, or security of Honeylove and the general public; and
  • For other purposes disclosed at the time you provide your Personal Information or as otherwise set forth in this Notice.

For the purposes discussed in this Notice, we may combine the information that we collect through the Services with information that we receive from other sources, both online and offline, and use such combined information in accordance with this Privacy Notice.

Use of Cookies

Our Services use various technologies such as cookies, beacons, tags and scripts (collectively referred to herein as “cookies”) for functionality, personalization, and online advertising purposes. These technologies are used in analyzing trends, administering the Services, tracking users’ movements around the Services and in gathering demographic information about our user base as a whole. We may receive reports based on the use of these technologies on an individual as well as aggregated basis.

Please note that you can change your settings to notify you when a cookie is being set or updated, or to block cookies altogether. Please consult the “Help” section of your browser for more information (e.g., Internet Explorer; Google Chrome; Mozilla Firefox; or Apple Safari). Please note that by blocking, disabling, or managing any or all cookies, you may not have access to certain features or offerings of the Services.

Online Analytics and Advertising

Online Analytics

We may use third-party analytics services on our Services (e.g., Google Analytics). These service providers may set and access their own cookies, pixel tags, and similar technologies on our Services and on third-party services to collect information that can be used to track users over time and across services. These analytics services help us understand how users arrive at and use our Services.
If you do not want Google Analytics to collect and use information about your use of our websites, then you can install an opt-out in your web browser. You also may opt-out from Google Analytics for Display Advertising or the Google Display Network by using Google’s Ads Settings.

Online Advertising

Honeylove strives to provide you with relevant, value-added content in our online advertisements. We work with online analytics and advertising partners to: (1) better understand the use of our Services so that we can improve our Services; and (2) deliver Honeylove advertisements that are more tailored to you both on our Services and on third-party Services.

Our partners may also place cookies, pixel tags and similar technologies on many online services, including ours. They use these technologies to collect information about your activities on these services in order to deliver you more relevant advertising. For example, they may use the information they collect from their cookies on our Services to identify Honeylove products and services you might be interested in and to recognize your device so they can show you relevant Honeylove advertisements while you are using our Services and other services. Additionally, we sometimes provide basic information we collect (such as email addresses) to service providers, who may “match” this information in de-identified form to cookies, mobile ad identifiers, and other proprietary IDs, in order to provide you with more relevant ads when you visit other online services.

Legal Basis for Processing Personal Information

Some jurisdictions (such as the EU and UK) require that we inform you about the legal bases on which we rely to process your Personal Information.  We rely on the following legal bases for processing your Personal Information:

  • Processing of your Personal Information that you provide to us when you interact with our Services, such as commenting in our community blog, watching our videos or making a purchase, is necessary to respond to or implement your request prior to entering into a contract (to complete your purchase) with us such as outlined in the Terms of Service.
  • We use account-related data to set up accounts for users of our Services and to administer and support those accounts (such as usernames, email address and billing information), provide you with access to the Services, contact you regarding your use of the Services or to notify you of important changes to the Services. Such use is necessary for the performance of the contract between you and us.
  • We will send you marketing communications only with your consent (if and where required by applicable law) or if you otherwise opt-in to receiving those communications. If you do not provide us with your consent to the processing of your Personal Information for this purpose, we will not send you this information. You have the right to withdraw your consent at any time as described below.
  • Our use of data relating to your use of the Services, described above, is necessary for our legitimate interests in understanding how the Services are being used by you, to improve your experience on it and our Services offerings. We also have a legitimate interest in aggregating and/or anonymizing the information that we collect through our Services and using this information for our business purposes, as described above. When we process your Personal Information for our legitimate interests, we make sure to consider and balance any potential impact on you, and your rights under data protection laws. Our legitimate business interests do not automatically override your interests – we will not use your Personal Information for activities where our interests are overridden by the impact on you, unless we have your consent or those activities are otherwise required or permitted by law. You have the right to object to processing that is based on our legitimate interests, as further described below.

Your Rights and Choices

We provide you with the ability to exercise certain controls and choices regarding our collection, use, and disclosure of your Personal Information. Your legal rights to exercise such controls and choices vary based on the laws of your jurisdiction (i.e., residents of certain US states (currently including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia) and residents of the EU, UK and Canada) can exercise the following rights by contacting us as detailed in the “Contact Us” section below or by completing our online form:

  • Access to, or a copy of, your information
  • Confirmation that we are processing your information
  • Correction or amendment of your information
  • Deletion of your information
  • Transfer of your information to a third party, where technically feasible
  • Opt out of automated processing that has significant or other legal effects (we do not currently engage in this type of processing)
  • Restriction or objection to certain uses of your information

If you have provided consent for us to use your information for a specific purpose, you may also request to withdraw that consent.  
In addition:

  • California and Oregon residents can request information about the categories of information we collect, disclose or sell or share about you; California residents can request the sources of such information, the business or commercial purpose for collecting or selling or sharing your information, and the categories of third parties to whom we disclose information. Such information is also set forth in this Privacy Notice.
  • Oregon and Minnesota residents can request a list of the specific third parties, other than natural persons, to which we have disclosed information.
  • EU/UK residents can object to the processing of information and to opt out of processing for direct marketing purposes.

If you are a resident of one of the U.S. states listed above, you also have the right to opt out of our processing or “sharing” of your information for online targeted advertising purposes. Note that these laws also allow you to opt out of the “sale” of your information to third parties in exchange for valuable consideration. Our use of analytics or online advertising tools as described in the “Online Analytics and Advertising” section above may result in the disclosure of your information to our third-party partners and that are subject to these opt out rights. You can opt out of both of these activities by clicking the “Your Privacy Choices” link on our website footer, or to opt out of these disclosures through offline means, please email us at support@honeylove.com with the subject line “Sale/Share Opt Out Request.” 

We may ask you to provide us with information necessary to reasonably verify your identity before responding to your request. We will consider all requests and provide our response within the time period required by applicable law. Please note, however, that certain information may be exempt from such requests. If you are a resident of Virginia, Minnesota, Montana, Oregon, Tennessee, Texas, Colorado, or Connecticut, and we deny your information request, you have the right to appeal our denial. You can exercise this right by contacting us at the contact details provided at the bottom of this Privacy Notice. Your description must include your full name and the email address used for your account with us, along with a copy of the denial notice you received from us.

Adjust your marketing and communication preferences:

Opt out of email marketing from Honeylove by following the instructions located at the bottom of our email marketing messages or by contacting us at support@honeylove.com. Please note, opting out or unsubscribing will not prevent you from receiving communications about your orders, product/software updates, or other important notices such as changes to our terms and policies, which are not marketing in nature.

Opt out of text (SMS/MMS) messages from Honeylove by following the instructions included in our messages.

How We Disclose Your Information

Service Providers

We disclose your Personal Information to our third-party service providers who provide services such as website hosting, payment processing, online chat functionality, data analysis, information technology, customer service, email delivery, online advertising, auditing, and other services. We use Shopify to power our online store. You can read more about how Shopify uses your Personal Information here: https://www.shopify.com/legal/privacy.

Third-Party Advertising

As discussed above, we may disclose certain information about you to our online advertising partners to assist in our online advertising and measurement activities.  See the “Online Analytics and Advertising” section above for information about how to manage these activities. 

Other

Aside from the instances described above, we will also disclose your Personal Information: 

  • to comply with the law;
  • to respond to claims or comply with legal process served on Honeylove (e.g., a lawful subpoena, warrant, or court order);
  • to enforce or apply our policies or agreements;
  • to protect and defend our rights or property or that of our customers, employees, visitors, or the public;
  • in connection with a business transfer, sale, liquidation, or merger;
  • if we reasonably and in good faith believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure; and
  • with your consent (if we find it necessary to request your consent, we will contact you via email or phone with the request).

Third-Party Links

The Services may contain links or references to other websites such as social media platforms, other websites, and event and partner websites. These websites are not covered by this Privacy Notice. Please review the Privacy Notices or Policies of those websites to understand the privacy practices of these third parties.

International Transfers of Data

The Services are operated from the United States. If you are located in another jurisdiction, please know that your information will be transferred to, stored, and processed in the United States. By using the Services and providing us with information, you consent to this transfer, processing, and storage of your information in the United States. It is important to note that the privacy laws in the United States may not be as comprehensive as those in other countries such as those in the European Union. We will require our service providers to use appropriate safeguards, such as having standard contractual clauses in place, when transferring your Personal Information to the United States. 

Security

We seek to use a variety of organizational, technical, and administrative measures to protect Personal Information. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. Where we have given you (or where you have chosen) a password so that you can access certain areas of our Services, you are responsible for keeping this password confidential. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please contact us at support@honeylove.com. 

SMS/MMS Mobile Messaging Marketing Program

We will only use information you provide through the SMS/MMS Mobile Messaging Marketing Program to transmit your mobile messages and respond to you, if necessary. This includes, but is not limited to, disclosing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages. With your permission, we may send text messages about our store, new products, and other updates. Updates include Checkout Reminders. Webhooks will be used to trigger the Checkout Reminders messaging system. WE DO NOT SELL, RENT, LOAN, TRADE, LEASE, OR OTHERWISE TRANSFER FOR PROFIT ANY PHONE NUMBERS OR CUSTOMER INFORMATION COLLECTED THROUGH THE MOBILE MESSAGING PROGRAM TO ANY THIRD PARTY. Nonetheless, We reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect Our rights or property. When you complete forms online or otherwise provide us with information in connection with the Program, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If, in Our sole discretion, We believe that any such information is untrue, inaccurate, or incomplete, or you have opted into the Program for an ulterior purpose, We may refuse you access to the Program and pursue any appropriate legal remedies.

Retention of Personal Information

Honeylove will retain your Personal Information only for as long as is necessary for the purposes set out in this Privacy Notice or as otherwise required for legal purposes. We will retain and use your Personal Information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your Personal Information to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.

Additional Information for California Residents

If you are a California resident, the California Consumer Privacy Act (“CCPA”) requires us to provide you with the following additional information about: (1) the purpose for which we use each category of “personal information” (as defined in the CCPA) we collect; and (2) the categories of third parties to which we (a) disclose such personal information for a business purpose, (b) “share” personal information for “cross-context behavioral advertising,” and/or (c) “sell” such personal information. Your Choices Regarding “Sale” and “Sharing”

You have the right to opt out of our sharing/sale of your personal information for purposes of online analytics and advertising by clicking the “Your Privacy Choices” link on our website footer, or to opt out of these disclosures through offline means, please email us at support@honeylove.com with the subject line “Sale/Share Opt Our Request.” 

Over the last 12 months, we have not knowingly “sold” or “shared” personal information of individuals under 16.

Other CCPA Rights

The CCPA also allows you to limit the use or disclosure of your “sensitive personal information” (as defined in the CCPA) if your sensitive personal information is used for certain purposes. Please note that we do not use or disclose sensitive personal information other than for business purposes for which you cannot opt out under the CCPA.

Please see the “Your Rights and Choices” section above for information about the additional rights you have with respect to your personal information under California law and how to exercise them. We will not discriminate against you for exercising these choices.

Notice concerning Do Not Track

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. We are committed to providing you with meaningful choices about the information collected on our websites for third-party purposes, and that is why we provide the variety of opt-out mechanisms listed above. Some web browsers offer users a “Do Not Track” privacy preference setting in the web browser. We do not currently recognize or respond to browser- initiated Do Not Track signals. California “Shine the Light” Notice

The California “Shine the Light” law (§ 1798.83) gives residents of California the right 
under certain circumstances to opt out of the disclosure of certain categories of personal information (as defined in the Shine the Light law) with third parties for their own direct marketing purposes, or in the alternative, that we provide a cost-free means for consumers to opt out of any such disclosure. If you are a California resident and you want to opt out of any such disclosures, please email us at support@honeylove.com with the subject line “Shine the Light Opt Out Request.”

Children's Privacy

Our Services are not directed at children under 16 years of age, and we do not knowingly collect or receive Personal Information from them. If we learn that we have received Personal Information from a child who is under 16, we will delete the data in accordance with legal requirements. If you believe that we have received Personal Information from a child under the age of 16, you may contact us at support@honeylove.com to request deletion of that information.

Changes to This Privacy Notice

We may change this Privacy Notice at any time. We will post all changes to this Privacy Notice on this page and will indicate at the top of the page the modified notice's effective date. We, therefore, encourage you to refer to this page on an ongoing basis so that you are aware of our current privacy notice. If required by the applicable law, we will notify you of the changes by other or additional means. By continuing to use the Services or providing us with information following such a replacement Notice being uploaded, you agree that you will be deemed to have agreed to be bound by the Privacy Notice as changed.
